In NSW these two situations go to different places — a court for money owed, a tribunal for a faulty product or service. Pick whichever fits. We’ll handle the rest.
A debt under a contract — you’re asking the court to give judgment for a specific sum. The defendant has 28 days to file a defence; if they don’t, you can apply for default judgment.
Local Court · Small Claims up to $20,000 (General Division to $100,000)
Examples: an invoice a customer never paid, a loan that wasn’t repaid, unpaid rent.
Faulty goods, defective workmanship, services that weren’t delivered as promised. You want a refund, repair, replacement, or compensation from the business that supplied them.
NCAT consumer claim · Up to $100,000
Examples: a car you bought that doesn’t work, a kitchen renovation done poorly, goods that don’t match the description.
